The crime of taking the life of another human being is considered the most serious of crimes. In Massachusetts, it can be punished by a life sentence without the opportunity of parole in state court; in the federal system, the death penalty exists. As a result, bail is often denied in such cases.
The laws regarding homicide, however, are not simple and there are varying degrees. For example, intentional pre mediated murder is treated differently from an accidental killing. Likewise, a death resulting from reckless behavior is treated differently from a mere accident. The difference between being prosecuted between the varying degrees of manslaughter and murder can often turn on one simple detail of the allegations.
