Swimming Pool Accidents

When the weather is hot, nothing is more enjoyable than a refreshing dip in a swimming pool. However, swimming pools also pose a serious danger, especially to children. In addition to the risk of drowning due to lack of supervision, swimming pools can have defective parts, such as drains or covers, that may result in serious injury or death.

Defective pool drains can be dangerous for children and adults alike. The suction of drains, which becomes stronger when the drain is blocked, can trap a person under the water. When a body part blocks the drain, the suction can become so powerful that the person, especially a child, cannot break free. As a result, children drown or suffer from serious complications, such as anoxic brain damage, every year. Defective pumps, poorly maintained and old equipment, and badly designed pools present the same dangers.

Products Liability and Premises Liability

Swimming pool accidents that are due to defective parts often result in products liability and premises liability lawsuits. Product manufacturers have an obligation to protect the safety of consumers by ensuring that their products are safe. If a design defect or malfunctioning part results in injury or death, the manufacturer should be held accountable.

On the other hand, well-designed pools can become dangerous when pool owners do not properly maintain their pool, make sure the premises is hazard-free, and provide adequate supervision to pool guests. A twenty-year old pool that hasn’t been properly maintained can pose serious risks to swimmers. Likewise, an otherwise safe, brand-new pool can be deadly when competent supervision is not provided, a defective pool cover is placed on top, or insecure fencing allows children to sneak in when adults are not present.

Prevent a Swimming Pool Tragedy

To minimize the risk of serious injury or death at your swimming pool, take these easy and inexpensive precautions:

  • Use a safety vacuum release system. This device detects when drains are blocked and automatically shuts down the pump.
  • Install proper fencing, with locking gates, around the perimeter of your pool.
  • Install a pool alarm system to alert you when someone enters the pool area.
  • Use a dual-drain system to reduce suction.
  • Post warning signs in multiple places in the pool area.
  • Inspect swimming pool parts, including covers, regularly. If you are concerned that any part of your pool is not functioning properly, have it looked at by a professional immediately.
  • Avoid overcrowding. Supervision is key, but even a competent adult will have a difficult time adequately supervising an overcrowded pool.
  • Never let children swim unsupervised, even for a moment. Drowning accidents can occur in the blink of an eye.
