Off-Label Marketing

One of the more common forms of Pharmaceutical Fraud, off-label marketing occurs when a company markets a medication for uses other than those approved by the Food and Drug Administration (FDA) and receives government subsidies for such medication. While it is not illegal for medications to be used for off-label purposes, pharmaceuticals prescribed for off-label uses may not be subsidized or reimbursed by the government if the uses are not FDA approved. Thus, if these pharmaceuticals are billed to Medicare or Medicaid, fraud has been committed.
