What If I Don’t Want To Go To Court?
Good lawyers are at home in the courtroom, but at Altman & Altman LLP we also understand that not all of our clients think the same way. Court can be a scary, intimidating and uncomfortable place – especially if you are going through a case involving trauma, tragedy or an emotionally difficult subject. Thankfully, going to court is not a necessity to emerge successful in your personal injury case or other legal matters.
At Altman & Altman, our clients are our top concern. All decisions relating to whether to settle, litigate or drop a case are purely the client’s to make. If you decide to drop your case at any time, we will honor that decision and charge no fee for our time.Settling out of court
If you do not wish to go to court, the good news for you is that most personal injury cases settle out of court. While most personal injury lawyers (at least any lawyer who is worth your time and money) will prepare for trial anyways, in very few instances is there no chance for a settlement.
There are certainly benefits to being ready for court, however, even if it winds up to be unnecessary. Showing the other person or entity, usually an insurance company, that you are prepared for trial turns up the heat and pressures them into making a fair offer.
Our goal is to make sure that our clients receive all that they are entitled to have, and we will certainly not hesitate to go to court to protect our clients. However, we work for our clients, and what they say goes. If a client does not want to go to court, then we respect the decision. We will inform you if we can see to a certainty that there is no possibility of settling your claim, and the decision as to how to proceed will be completely in your hands.Arbitration and mediation
Additionally, there are alternative ways to have your case resolved without going to court. There has been a large movement in the legal and insurance industries to have cases resolved or negotiated through binding arbitration (where an arbitrator makes a final decision between the parties after hearing evidence), non-binding arbitration (where the terms set by an arbitrator are not legally binding) and mediation (another word for a structured negotiation).
We have had great success in resolving some of the most difficult cases through these alternative dispute resolution venues. Our clients are often very satisfied with the results we are able to achieve using these settlement tactics.Contact us no matter the case, we’ll see how we can help
