There has been a large movement in the legal and insurance industries to have cases resolved or negotiated through binding arbitration (where an arbitrator makes a final decision between the parties after hearing evidence), non-binding arbitration (where the terms set by an arbitrator are not legally binding) and mediation (another word for a structured negotiation).
